Terms & Conditions
The rules for using this site, what sending us a form does and does not do, the terms of our client text-messaging program, and where we stand on liability. Client engagements are governed by their own written agreement, not this page.

Agreement to these terms
These Terms & Conditions (“Terms”) govern access to and use of www.darkcom.co (the “Site”), operated by DarkCom Enterprises LLC (“DarkCom”, “we”, “us”). By accessing or using the Site you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.
If you use the Site on behalf of a company or other organization, you represent that you have authority to bind that organization, and “you” includes it.
What these terms cover
The Site is an informational and lead-generation website. It describes what we build; it does not itself provide engineering, automation, voice-agent, or any other services. Those services are provided only under a separate written agreement — a proposal, statement of work, or master services agreement — between DarkCom and the client. Where that agreement and these Terms conflict on any matter concerning the services, the agreement controls.
Nothing on the Site is an offer capable of acceptance. Descriptions of capabilities, engagement models, response times, and pricing bands are an invitation to start a conversation, not a commitment to enter into one.
These Terms also set out the terms of the text-messaging program we operate for our clients, in §06.
Using the site
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your own business or personal informational purposes. You agree not to:
- use the Site in any way that violates applicable law or regulation;
- copy, scrape, crawl, harvest, or mirror the Site or its content by automated means, other than a search engine indexing the Site in accordance with our robots directives;
- probe, scan, or test the security of the Site or its hosting, or attempt to bypass any protective measure, without our prior written permission;
- interfere with the operation of the Site, its hosting, or any other user’s access to it, including by flooding it with requests;
- submit malicious code, or content that is unlawful, defamatory, infringing, deceptive, or that you have no right to share, through any form;
- use the forms to send unsolicited commercial messages or to submit anything by automated means;
- impersonate any person or organization, or misrepresent your affiliation with one.
We may restrict, suspend, or block access to the Site at our discretion, including where we suspect abuse, without notice or liability.
Forms and submissions
Accuracy
When you send a brief, inquiry, application, or subscription, you agree that the information is accurate, that it is yours to share, and that you will let us know if it changes materially while we are still talking.
No engagement is formed
Sending us a submission does not create an engagement, a contract, or any obligation on our part to provide services, and it does not create a confidential, fiduciary, or attorney–client-style relationship. Statements on the Site about how quickly we reply describe our practice and our intent; they are not a contractual promise.
Confidentiality
The forms are not a channel for confidential material. Do not send trade secrets, credentials, classified information, or technical data subject to export controls through them or by unencrypted email. We will handle anything you send in accordance with our Privacy Policy, but we accept no obligation of confidentiality for unsolicited material; confidential exchange happens under a non-disclosure agreement arranged separately. Ideas contained in a submission — the problems you describe, the approaches you suggest — do not become yours by virtue of having been sent to us, and we may be working on similar things independently.
Careers applications
An application is not an offer of employment or engagement, and receiving one does not oblige us to interview or respond within any particular time. Any employment or contracting relationship is subject to a separate written agreement and to whatever eligibility, background, or clearance verification the role lawfully requires. You authorize us to keep your application on file for the period described in the Privacy Policy.
Signal Brief
The Signal Brief is a free, occasional email you can subscribe to with your email address. You may unsubscribe at any time. We may change its content, frequency, or format, or discontinue it altogether, without notice. Its content is general information, subject to §10 below.
Text messaging (SMS) program
DarkCom Enterprises LLC operates a text-messaging (SMS) program for its clients. Messages are sent only to clients who have opted in, and only about that client’s own account with us: project notifications, payment reminders, and account communications. The program is customer care. It is not marketing, and no promotional or advertising messages are sent through it.
Consent
You opt in by checking the SMS consent box on the client onboarding form. The box is never pre-selected, and consent is not a condition of purchasing any service. By opting in you agree to receive these messages at the mobile number you provide, you confirm that you are the account holder or an authorized user of that number, and you agree to tell us if the number changes.
Frequency and cost
Message frequency varies with your account activity, up to 6 messages per month. Message and data rates may apply.
Opting out and getting help
Reply STOP to any message to cancel. You will receive one final message confirming that you have been unsubscribed, after which no further messages are sent unless you opt in again. Reply HELP to any message for help, or contact customer support at dcants@darkcom.co or through the contact form.
Carriers and delivery
Carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier, your device, and network conditions outside our control.
Your information
How we collect, use, keep, and protect your mobile number and consent record is described in our Privacy Policy. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.
Content and intellectual property
The Site and everything on it — text, graphics, the DarkCom name, mark, and wordmark, the design, and the underlying code — is owned by DarkCom or licensed to us, and is protected by copyright, trademark, and other intellectual-property laws. Except for the license in §03, you may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any part of the Site without our prior written permission. Brief quotations with attribution and a link to the source page are fine.
Nothing on the Site grants you any right to use the DarkCom name or mark. Names and marks of third parties that appear on the Site — including providers, tools, platforms, and standards bodies — belong to their respective owners and are used for identification only. Their appearance does not imply any affiliation with, sponsorship of, or endorsement by those parties.
Statements about clearances, agencies, and past work
The Site describes a security clearance held by an individual member of our team. That statement reflects the individual’s status at the time of publication and may change. A personnel clearance belongs to the person, not the company: DarkCom does not hold a facility clearance, CAGE code, SAM.gov registration, or any certification not expressly stated on the Site, and access to classified work is arranged under a sponsoring prime contractor’s security program.
Where the Site names a government agency or laboratory, it does so to identify the prior experience of individual key personnel only. No agency name implies an active contract, an endorsement, sponsorship, or any affiliation with DarkCom. These statements are informational. Do not rely on them for procurement, eligibility, or security decisions without verifying them through the appropriate official channel.
Third-party services and links
The Site is hosted by Vercel and delivers form submissions through Web3Forms, each of which operates under its own terms. The Site also links to third-party websites for convenience. We do not control those services or sites, make no representation about them, and are not responsible for their content, availability, or practices. Your use of them is at your own risk and subject to their terms.
Information only; no professional advice
Content on the Site — including references to laws, regulations, standards, and governance frameworks — is general information that reflects our engineering viewpoint at the time it was written. It is not legal, compliance, security, financial, or other professional advice, it may not reflect the most current developments, and it does not create any warranty or representation about your own compliance obligations. Consult a qualified professional before acting on anything you read here.
Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR COMPLETENESS, AND ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THAT CASE THE EXCLUSIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DARKCOM AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE OR ITS CONTENT, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS (US$100). THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, AND NOTHING IN THESE TERMS LIMITS LIABILITY UNDER A SEPARATE WRITTEN SERVICES AGREEMENT, WHICH CARRIES ITS OWN TERMS.
Indemnification
You agree to defend, indemnify, and hold harmless DarkCom and its members, managers, employees, contractors, and agents from and against any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising out of or relating to your breach of these Terms, your submissions, or your misuse of the Site.
Governing law and disputes
These Terms, and any dispute arising out of or relating to them or to the Site, are governed by the laws of the State of Georgia and the federal laws of the United States, without regard to conflict-of-law principles. Subject to the paragraph below, you agree that any such dispute will be brought exclusively in the state or federal courts located in the State of Georgia, and you consent to their personal jurisdiction and venue.
Before filing any claim, you agree to contact us at dcants@darkcom.co with a written description of the dispute and to work with us in good faith for thirty (30) days to resolve it informally. Either party may seek injunctive or other equitable relief at any time to protect its intellectual property.
Changes to these terms
We may revise these Terms from time to time. The effective date at the top of the page tells you when they last changed, and material changes will be noted prominently on the Site. Revisions take effect when posted. Continued use of the Site after that means the revised Terms apply to you.
General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and DarkCom concerning use of the Site, and supersede any prior understanding on that subject. They do not affect any separate written agreement for services.
- Severability. If any provision is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions stay in full force.
- No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign or transfer these Terms. We may assign them in connection with a merger, acquisition, reorganization, or sale of assets.
- No third-party beneficiaries. These Terms create no rights in anyone other than you and DarkCom.
- Electronic communications. You consent to receive communications from us electronically at the email address you provide, and agree that they satisfy any legal requirement that a communication be in writing.
- Interpretation. Headings are for convenience only, and “including” means “including without limitation”.
